Premier Wheatley emphasised the importance of compliance with recommendations from the Caribbean Financial Action Task Force (CFATF). “While these ratings are an indication of our commitment and diligence to satisfying our obligations, they also point out the need for further enhancement of our legal framework,” he stated.

He highlighted specific areas requiring urgent reform, including the investigative powers of law enforcement and the ability to effectively combat financial crimes. He pointed to gaps in recommendation thirty-one and immediate outcomes seven and eight of the CFATF Mutual Evaluation Report (MER).

“The MER discloses that our policing framework lacks the advanced investigative techniques necessary for confronting complex investigations such as controlled deliveries and undercover operations,” Premier Wheatley said. He underscored the need to empower law enforcement with tools for production, search, and seizure, not only for domestic cases but also for international cooperation.

“These amendments are vital to reinforcing our legal framework, enhancing cooperation among domestic and international agencies, and aligning our strategic initiatives with international standards and global best practices,” he added.

Premier Wheatley also reflected on the territory’s historical reputation for peace and low crime rates, contrasting it with current challenges. “Madam Speaker, we all grew up in a Virgin Islands which was peaceful. You could go several years without even having one murder,” he said. Despite recent upticks in crime, he maintained, “We are still relatively low crime.”

He criticised those seeking to politicise the bill, stressing its urgency and importance. “I would not return this new session for a second and third reading unless it was of the utmost urgency,” he declared.

The bill introduces sections 30(5)(b) and 30(5)(c), aimed at bolstering law enforcement’s effectiveness in combating financial offenses and ensuring compliance with international standards. These provisions are designed to enable the confiscation of criminal proceeds, facilitate the return of stolen assets, and deny criminals the benefits of their illegal activities.

“By equipping our law enforcement with the necessary powers and tools to thoroughly investigate and prosecute money laundering offenses, we are not just fulfilling our international obligations but creating an environment that allows for the proper detection and punishment of criminal activities,” the Premier said.

He closed his remarks with a call for collective action to protect the territory’s reputation as a secure financial center. “We must act resolutely to increase our compliance ratings, address the deficiencies identified in the Caribbean Financial Action Task Force Report, and maintain the Virgin Islands’ reputation as a secure and stable financial center,” he urged.
The Police Amendment Bill 2024 is expected to undergo its second and third readings in the coming weeks, with hopes of swift passage to address the pressing legal and policing challenges facing the territory.

In his remarks to the public, Premier Wheatley took aim at the Opposition for spreading what he called “misinformation” and for directing “vicious comments” towards the Honourable Speaker of the House of Assembly, whom he insists was not at fault in this matter. “It is unfortunate that some persons have chosen to be selective with the facts,” Wheatley stated, “taking Virgin Islands politics to a dark place.”

The Premier reiterated that while every member of His Majesty’s Loyal Opposition has the constitutional right to challenge the Government, “persons cannot on one hand profess to be the vanguards of law and order, and truth and righteousness, and then flout the rules and regulations just because it is convenient to their agenda.”

He further called on the Opposition to apologise to the Speaker for “pre-empting her ruling, walking out of the House while she was delivering her ruling, and casting aspersions against her integrity.” According to Wheatley, “a higher standard of conduct is expected from those who aspire to lead the country.”

The controversy arose from the Opposition’s failure to adhere to the procedures for filing their Motion of No Confidence. The Premier emphasised that the Standing Orders, amended in 2016, clearly distinguish between Government Business and Private Members’ Business. He argued that the Opposition’s motion was categorised under Private Members’ Business, and that the Speaker’s ruling was correct. “A simple reading of the Standing Orders will show that the Opposition’s Motion was clearly Private Members’ Business, and the Honourable Speaker was correct in her ruling,” Wheatley asserted.

Premier Wheatley went on to accuse the Opposition of prioritising political gamesmanship over the completion of critical reforms, claiming that the timing of their Motion was intended to undermine the Government’s efforts to petition the UK for the lifting of the Order in Council. “The Opposition prioritises ‘brownie points’ over the completion of the recommendations and the removal of the threat to suspend our Constitution,” he charged.

As he concluded his statement, the Premier reaffirmed his administration’s commitment to serving the public, highlighting ongoing efforts to repair roads, address infrastructure challenges, and finalise the steps necessary to meet the Commission of Inquiry’s recommendations. “My Administration remains united and firmly committed to our responsibility,” Wheatley stated. “There is a lot that needs to be done instead of staging walkouts and press conferences.”

He closed by expressing his readiness to engage in debate when the Motion is properly brought forward, adding, “I look forward to responding to the Motion when it does come up for debate, assuming the Opposition complies with the Standing Orders of the House.”

Governor Daniel Pruce reiterated the urgency of the situation at his August 30 press conference, stating, “We cannot slow down.”

He and Premier Wheatley are scheduled to travel to the United Kingdom for talks with the UK Minister for Overseas Territories to discuss the next steps.

In February, former Minister for the Americas, the Caribbean, and UK Overseas Territories David Rutley issued a stern warning, cautioning that slow progress on the CoI reforms could prompt further British intervention.

“The Commission of Inquiry has identified serious governance and reputational issues, but progress on implementing its recommendations has been too slow, with agreed deadlines missed. That is why I am here: to listen and understand from those working directly on the reforms how they can be delivered quicker so that the people of BVI get the good governance they deserve,” Rutley said in a statement issued by the Governor’s Office on February 5.

At that time, the government had addressed only twenty-five of the forty-five identified reforms, with just five months remaining before the deadline.

The report warns that failure to meet this deadline could result in the retention of the Order in Council, potentially leading to a two-year constitutional suspension.

The CoI, initiated by former Governor Augustus Jaspert in January 2021, was established to investigate potential corruption and abuse within the public sector.

Inquiry Commissioner Sir Gary Hickinbottom presented a detailed 900-page report on April 4, 2022, highlighting extensive corruption and offering recommendations, including the partial suspension of the constitution to reform the BVI’s governance structures.

Following Premier Andrew Fahie’s arrest in April 2022 on drug and money laundering charges, an interim government led by Premier Natalio Wheatley took office.

Wheatley, who was previously Deputy Premier, led efforts to prevent a constitutional suspension.

In the 2023 elections, political parties pledged to uphold the CoI reforms as part of their commitment to safeguard the territory’s political autonomy.

Premier Wheatley was re-elected in April 2023.

Mrs. Georges, who held the distinction of being the Territory’s first psychologist and mental health/psychiatric nurse, played a transformative role in advancing mental health services. After furthering her education overseas, she returned to the Virgin Islands to establish the Community Mental Health Programme in 1972, an initiative that brought much-needed follow-up care to patients within the community. Her leadership emphasized preventative, continuity, and rehabilitative care, elements that helped the programme gain recognition as a model system by the Pan American Health Organization.

“She was a visionary leader and a passionate advocate for mental health care,” said Dr. Wheatley. “Her influence on healthcare, especially in the mental health sector, has left an indelible mark on our community.”

Mrs. Georges was instrumental in founding the Mental Health Association in 1975 and was a mentor to countless nurses across the Territory. Many nurses recall her as a pivotal figure in their careers, often crediting her with providing them their start and encouraging further education and professional development. As Chief Nursing Officer from 1987 to 1994, she played an active role in regional and international nursing organizations, including the Caribbean Nurses Organisation and the International Council of Nurses, where her advocacy helped elevate the standards of nursing care in the Virgin Islands.

A stalwart in nursing and healthcare, Mrs. Georges served as a founding member of the BVI Nurses Association, where she held several key positions, including president and secretary. Her involvement in the Caribbean Nursing Association further solidified her reputation as a leader and advocate for nurses in the region, steering local nursing practices towards greater effectiveness and professionalism.

Mrs. Georges’ influence extended beyond the Virgin Islands, as her work and advocacy opened numerous doors for nurses locally and abroad. Her efforts to obtain membership in the International Council of Nurses ensured that nurses from the Territory could benefit from global advancements in the field. Colleagues describe her as approachable, deeply caring, and steadfast in her commitment to patient care and higher education.

Even in retirement, Mrs. Georges remained connected to the field she loved, taking a keen interest in ongoing developments within nursing. Her legacy also includes contributions as an editor and writer for various government publications, where she documented the history and progress of healthcare in the Virgin Islands.

Mrs. Georges’ impact on the Virgin Islands was profound and far-reaching, touching lives locally, regionally, and internationally. She is remembered as a dedicated public servant whose work was driven by a passion for excellence and compassion for others.

The Territory extends its heartfelt condolences to her children, Noni and Kamau, her granddaughter, Eden, her siblings, and the extended Frett and Malone families.

Mrs. Rita Frett-Georges’ legacy will endure, her name forever etched in the history of the Virgin Islands as a pioneer in healthcare and a champion for mental health and nursing excellence.
