Nyron Erickson is challenging the Director of Public Prosecutions’ (DPP) attempt to commit him to trial in the High Court of the British Virgin Islands on charges including unlawful possession of a firearm, cocaine, marijuana, and money laundering. The Crown’s case rests on alleged communications between Erickson and co-accused Jose Almestica, who was arrested in December 2021. Erickson’s defence contends that the evidence presented is inadmissible hearsay and insufficient to establish a prima facie case.

Central to the defence’s argument is the nature of the evidence derived from alleged WhatsApp communications between Erickson and Almestica. The Crown’s reliance on forensic extraction reports and voice analysis to link Erickson to incriminating messages on Almestica’s recovered mobile phone has been challenged as inadmissible hearsay. According to the defence, this evidence cannot stand under the scrutiny of established legal principles.

The defence contends that a close examination of the evidence in the committal bundle reveals that the purported telephone evidence is hearsay upon hearsay. They argue that the forensic extraction report, which purportedly shows WhatsApp messages linked to Erickson, is a statement made outside of court and is thus inadmissible. Additionally, the defence points out that the statement by Ms. Kim Wharton, who testified to the monikers associated with Erickson, further represents inadmissible hearsay. Wharton’s testimony relies on previous assertions not made while giving oral evidence in court, violating the rule against hearsay as established in R v Sharp [1988] and R v Kearley [1992].

The defence also references the Privy Council decision in Delroy Hopson v R [1992], which underscores that statements made outside the presence of the accused are inadmissible. In this case, any attributed designations linking Erickson to Almestica via WhatsApp messages were made in Erickson’s absence, further breaching the hearsay rule.

The issue extends to other pieces of evidence in the committal bundle, such as the designation of “WestBank” and “BandSpatron” as monikers associated with Erickson. The defence argues that these attributions are based on inadmissible voice analysis and previous statements that Wharton could not testify to in court. The defence cites the Williams v Bedwellty Justices [1996] case, which emphasises that committal proceedings must be based on admissible evidence. Any committal based on inadmissible hearsay evidence is liable to be quashed by way of judicial review and the remedy of certiorari.

Furthermore, the defence points to the principle established in R v Gunewardene [1951] and R v Dennis Lobban [1995], stating that the extrajudicial statements of a co-accused are not admissible as evidence against the defendant. In the current case, any statements made by Almestica outside of court cannot be used to implicate Erickson. The defence highlights that Ms. Wharton’s statement and the forensic extraction report are both examples of such extrajudicial statements, making them inadmissible.

The defence also critiques the methodology and credibility of the forensic extraction and voice analysis. They argue that these techniques are not only subject to significant error but also that their results were presented without the proper foundational evidence or expert testimony to verify their accuracy. This further undermines the reliability and admissibility of the evidence against Erickson.

In their argument, the defence submits that there is no admissible evidence to support the committal of Erickson for trial in the High Court. The statements and forensic reports relied upon by the Crown are riddled with inadmissible hearsay and fail to establish a prima facie case. The defence urges that, in the absence of such evidence, the charges against Erickson should be dismissed.

On February 27, 2023, Erickson was extradited to the United States Virgin Islands after unsuccessful appeals in the local Court of Appeal and in the United Kingdom Privy Council. He was charged with conspiracy to launder monetary funds from outside the United States and unlawfully transporting the funds into the United States. After six months in federal custody, prosecutors dismissed the case against him. Despite this, Erickson faced renewed legal challenges when, on 20 September, 2023, he was arrested in Road Town by local authorities as he stepped off the ferry from the United States Virgin Islands.

A joint operation between the Royal Virgin Islands Police Force (RVIPF) Marine Unit and the U.S. Customs and Border Patrol late Thursday night resulted in the interception of a vessel carrying an estimated $34 million worth of cocaine.

The operation, which took place shortly after 11 p.m. on May 30, led to the discovery of multiple packages suspected to contain the illicit drug.

The three men aboard the vessel, identified as Julio Cabrera Martinez, 40, Tomas Balbuena Acosta, 55, and Remigio De Los Santos, 62, have been formally charged with Possession of a Controlled Drug and Possession of a Controlled Drug with Intent to Supply.

Commissioner Collins of the RVIPF remarked on the significant seizure, stating, “This significant bust underscores the RVIPF’s ongoing commitment to disrupting drug trafficking operations in the Virgin Islands.”

The suspects remain in custody awaiting their appearance at the Magistrate’s Court.

The Royal Virgin Islands Police Force has filed charges against three individuals in connection with the discovery of firearms, ammunition, and drugs on Friday, March 1st, in Purcell Estate.

Seantroy Hanley, 36, and Jahkeema Charles, 32, both residents of Fat Hog’s Bay, face multiple charges including possession of firearms without a license, unlawful possession of explosives, and possession of controlled substances with intent to supply.

Meanwhile, Quentin Noel, 19, from Purcell Estate, has been charged with possession of a controlled substance.

While Charles has been granted bail in the amount of $40,000 and is scheduled to appear at the Magistrate’s Court on April 18, Hanley and Noel remain in custody awaiting their respective hearings.

During the search, conducted after 5 pm in the vicinity of the basketball court in Purcell Estate, officers uncovered two firearms, multiple rounds of ammunition, a significant quantity of marijuana, and crack cocaine.

The discovery has prompted urgent calls from the RVIPF for anyone with information regarding illegal firearms to come forward and report anonymously to the Crime Stoppers line at 800-8477 (TIPS) or overseas callers at 1-284-800-8477. Additionally, individuals can contact the RVIPF Intelligence Unit at 368-9339 with pertinent information.

However, moments after the verdict, two jurors reached out to express apparent misgivings, sparking an uncommon post-trial dispute.

Judge Williams, presiding over the case, finds herself in uncharted legal territory, as both federal prosecutors and defense attorneys present conflicting views on how to address the jurors’ concerns. Former Premier of the British Virgin Islands Andrew A. Fahie has been found guilty in a Miami court of conspiring to import cocaine into the United States and conspiring to launder a significant sum of money, charges which carry sentences ranging from 20 years to life.

After a trial spanning seven days, a diverse jury rendered a guilty verdict against the former politician who also faces potential fines amounting to US$10 million. The jurors deliberated for a mere four hours before arriving at their decision. Fahie, who was previously out on bail, was handcuffed and taken into custody.

His journey from the corridors of power to a courtroom in Miami has been nothing short of extraordinary. Arrested on April 28, 2022 by agents of the Drug Enforcement Administration (DEA) at Miami-Opa Locka Executive Airport, Fahie made international headlines, shocking many supporters in his homeland.

Fahie, whose political career once seemed destined for greater heights, the verdict represents a stunning reversal of fortune.

However, as the trial progressed and evidence was presented, the territory closely followed the prosecution’s case which included extensive incriminating conversations recorded by undercover DEA agents, phone records, and testimony from the prosecution’s key witness, Oleanvine Pickering Maynard, who secured a reduced sentence through a negotiated deal.

Maynard and her son, Kadeem Stephan Maynard, found themselves apprehended in the drug sting. The male counterpart also entered into an agreement with federal authorities, resulting in a five-year sentence.

A former mathematics teacher turned lawmaker, he ascended to prominence as the representative for District One in 1999, a position he held steadfastly for 23 years. Throughout his tenure, he wielded significant influence, serving in various ministerial capacities and ultimately assuming leadership of the Virgin Islands Party (VIP).

Fahie led the VIP to a return to power in the 2019 general election, upending the long-standing dominance of the National Democratic Party. His ascent to power was met with both acclaim and scrutiny, reflecting the complex dynamics of Caribbean politics.

Fahie’s once unassailable reputation began to crumble. In November 2022, facing mounting legal pressure and public scrutiny, he resigned from his position as chairman of the VIP and withdrew from the political arena altogether.

Fahie’s sentencing Is scheduled for April 29.

Maynard, having pleaded guilty to conspiring with Fahie to import cocaine into the United States, agreed to testify against him in exchange for a potentially lighter sentence.

Her testimony, which stretched over six hours on Tuesday and resumed on Wednesday morning, offered a glimpse into a world of clandestine meetings and coded conversations. Prosecutors played secret recordings as Maynard detailed interactions with Fahie, her son Kadeem Maynard, and the Drug Enforcement Administration (DEA) operatives, shedding light on alleged drug trafficking operations.

“On the recording,  Maynard was heard explaining to DEA confidential source who used the named “Roberto Quintero” what she hoped to gain from their arrangement. “There are things I want to accomplish. One is to pay off my house in Tortola. And when I retire I want to go to Miami. And in both areas, I want to be rent-free,” she said. Quintero then asked her to open her bag and he gave her $10,000, Ms. Maynard said. “It’s just $10,000: a little present for you,” he was heard to say on the tape. Maynard replied, “Thank you.”

As the prosecution’s fifth and final witness, Maynard’s testimony served to tie together pieces of evidence presented by prior witnesses, including DEA agents and digital forensic analysts. Her guilty plea in June 2023 to conspiracy charges marked a turning point in the trial, offering prosecutors a crucial insider perspective on the alleged conspiracy.

During her testimony, Maynard revealed how she first became entangled in the web of drug trafficking, describing meetings with associates and a DEA confidential source named “Roberto Quintero.” She detailed negotiations with Fahie, including discussions of profit-sharing agreements and a substantial cash “gift” exchanged between Fahie and Quintero.

As Maynard’s testimony continued, the courtroom remained transfixed by the unfolding drama, with Fahie continuing to deny any wrongdoing. Yet, her revelations painted a vivid picture of an alleged conspiracy spanning multiple jurisdictions.

Almost twenty-four months after his apprehension at Miami Airport in the United States, the cocaine smuggling and money laundering trial of former British Virgin Islands Premier Andrew Fahie started on Monday, January 29.

In April 2022, Fahie along with Oleanvine Pickering Maynard, the Managing Director of BVI Ports Authority, and her son, Kadeem Stephan Maynard, were arrested during a sting operation by the Drug Enforcement Administration (DEA).

The trio was charged with conspiring to traffic cocaine and launder money by facilitating the secure passage of substantial quantities of Colombian cocaine through BVI ports destined for Miami.

The Maynard duo entered into an arrangement with federal authorities, pledging to provide testimony against Andrew Fahie.

In November 2023, Kadeem received a federal prison sentence of nearly five years for his involvement in a cocaine trafficking operation. Currently, his mother is in federal custody awaiting her sentencing day in court.

During the court proceedings on Monday, Fahie’s attorney Theresa Van Vliet  filed a motion aimed at restricting prosecutors from introducing any evidence extracted from her client’s phone.

She contended that the material in question included personal health information about Fahie’s relatives, which she argued is irrelevant to the case.

Additionally, Van Vliet raised concerns about whether the Government of the British Virgin Islands had been consulted to address and resolve potential confidentiality or privacy issues related to the evidence.

The submitted evidence encompassed correspondence between Fahie and BVI Police Commissioner Mark Collins, as well as Fahie’s assistant and building contractor.

In December 2023, the prosecution submitted a comprehensive list of exhibits, encompassing recordings of phone conversations and meetings involving Fahie and the Maynards.

The prosecution plans to present data extracted from several of Fahie’s devices, such as a Note 10+ mobile phone and a Surface tablet.

Judge Kathleen Williams has not yet rendered a decision on the defence motion.

The prosecution’s case is that Fahie and the Maynards stood to gain millions, with the funds strategically routed through various businesses and bank accounts to obscure their origin.

The criminal complaint affidavit said they engaged in a sequence of meetings during March and April of 2022 with an alleged drug trafficker to finalise the illicit deal.

The affidavit contends that Fahie and Oleanvine Maynard were responsible for obtaining necessary licences, ensuring the concealment of cocaine-laden vessels within BVI ports, and discreetly influencing a potentially troublesome government official.

Discussions reportedly included plans to conduct a trial run involving 3,000 kilograms of cocaine through a BVI port, followed by subsequent shipments of similar quantities once or twice a month over four months.

The alleged compensation for Fahie and O. Maynard was tied to a percentage of the proceeds from the cocaine sales, totaling millions of dollars.

While the Maynards remained in federal custody, in May 2022, Fahie was granted $500,000 bail, a move contested by prosecutors who contended that his release posed a flight risk, coupled with the potential for engaging in illicit activities upon regaining freedom.


The terms of his bail dictated that the former premier remained in Miami, restricted to the leased residence of his two college-aged daughters. 

 
To further ensure compliance, both he and his family had to relinquish their passports to the authorities. He also wears an ankle bracelet monitor.
