– Prosecutors Seeking Life Sentence

Former British Virgin Islands Premier Andrew Fahie will learn his fate today, August 5, at his sentencing hearing in the United States, with Federal prosecutors seeking a life sentence from U.S. District Court Judge Kathleen Williams.

The 53-year-old, who is a father of two, was convicted in February on charges of cocaine trafficking and money laundering.

However, in June, Fahie’s lawyer requested a ten-year prison term for his client, minimising his involvement in the operation that led to his arrest.

Fahie, along with former BVI Ports Authority Director Oleanvine Maynard, 62, and her son Kadeem Maynard, 33, were arrested by U.S. law enforcement in April 2022.

The Maynards reached plea deals with the prosecution, with Oleanvine receiving a sentence of over nine years and Kadeem sentenced to nearly five years.

Oleanvine Maynard served as a key witness in Fahie’s case, linking the conspiracy to use the territory as a transshipment hub for narcotics into the U.S. Federal prosecutors argue that Fahie played a significant role in the operation as the head of the BVI.

The case has been a major embarrassment for the territory, with prosecutors naming several BVI officials who were allegedly involved in the scheme but who have not been charged.

Fahie’s arrest sent shockwaves through the territory, particularly among his supporters who closely followed the trial.

Fahie’s political career began in 1999 when he was elected as a House of Assembly member for the First District, a role he held until his arrest in 2022.

His tenure was marked by a focus on strengthening the economy through tourism and financial services, and he also emphasised youth involvement in national development.

On 30 November 2016, Fahie became the leader of the Virgin Islands Party, the oldest political party in the territory, after defeating incumbent Julian Fraser.

He was appointed Leader of the Opposition on 6 February 2017 and led his party to victory in the 2019 general election. Fahie assumed office as Premier on 7 February 2019, a milestone celebrated throughout the territory.

In November 2023, while on bail in the U.S. with travel restrictions imposed on him and his family, Fahie announced his retirement from politics. In his resignation letter, he requested that his retirement, effective 24 November 2022, be communicated to all relevant authorities, including members of the House of Assembly and the people of the Virgin Islands, particularly those from the First District.

He stated: “I humbly and respectfully request of you to please officially convey my retirement that comes into effect from 24 November 2022, to all the requisite authorities especially to all members of the House of Assembly, as well as to the people of the Virgin Islands – especially my beloved people of the First District on the floor of the House of Assembly via this letter, among other means you may deem appropriate.”

Since his retirement announcement in November 2023, Fahie has not issued any further public correspondence.

He is now set to serve his sentence in a federal prison.

Andrew Arturo Fahie, the former Premier of the British Virgin Islands, has formally objected to his presentence investigation report and requested a reduced sentence ahead of his August 5 sentencing. This follows his February conviction on multiple charges, including conspiracy to import cocaine and money laundering.

Fahie, arrested in April 2022 during an elaborate DEA sting operation, faces significant prison time after a jury found him guilty on four out of five counts of a superseding indictment. The charges include conspiracy to import cocaine, conspiracy to engage in money laundering, attempted money laundering, and foreign travel in aid of racketeering.

In his objections, Fahie challenges several aspects of the presentence report, particularly the characterisation of the offense and his alleged role. He argues that the operation was a law enforcement sting involving purported drug dealers using the port at Tortola in the BVI as a temporary storage facility. Fahie maintains that there were no laboratory tests proving the presence of cocaine and that the substances involved would not test positive for cocaine until they reached Puerto Rico, thus disputing the importation charges.

Additionally, Fahie contests the inclusion of Lebanese Hezbollah operatives in the report, noting the government’s lack of evidence connecting him to these individuals, a point he claims is highly prejudicial. He also disputes his involvement in a “side deal” between his co-defendants and a confidential source, which the government acknowledged at trial.

Fahie argues for a mitigating role adjustment, highlighting his lesser involvement compared to his co-defendants, Oleanvine and Kadeem Maynard, who he claims played more substantial roles in the scheme. Notably, Kadeem Maynard received a two-level reduction for a minor role and was sentenced to 57 months imprisonment, a factor Fahie emphasises in seeking a similar reduction.

Despite these arguments, Fahie’s legal team acknowledges that even with a mitigating role adjustment, the advisory guideline range might be higher due to the money laundering guidelines. Nonetheless, they argue for a sentence at the statutory minimum of 120 months, citing his previously unblemished record, his contributions to his community, and the non-violent nature of the offense.

Fahie, who has been in custody since his conviction, asserts that a 120-month sentence would be sufficient to reflect the seriousness of the offense, promote respect for the law, and provide just punishment without being greater than necessary. He emphasizes the need for individualized sentencing, considering his background, character, and the unique circumstances of the case.

As sentencing approaches, the court will weigh these objections and the motion for a downward variance against the guidelines and the statutory requirements, with the potential to set a precedent in how similar cases are adjudicated in the future.

A Miami federal judge upheld the jury’s unanimous guilty verdicts, leaving former British Virgin Islands Premier Andrew Fahie vulnerable to a potential sentence of 10 years to life in prison on the primary charge of conspiring to import cocaine into the United States through the British territory.

Fahie, 53, was also found guilty of three additional charges related to money laundering and racketeering. His sentencing is scheduled for April 29.

The controversy arose when two jurors contacted the judge’s office shortly after the guilty verdict, expressing second thoughts about their decision. Despite arguments from both federal prosecutors and defense attorneys, Judge Williams ultimately upheld the unanimous verdicts, citing legal precedent.

Of particular concern to the judge was the interaction between one juror and Fahie’s defense attorney, raising questions about potential outside influence on the jury’s deliberations. Former Premier of the British Virgin Islands Andrew A. Fahie has been found guilty in a Miami court of conspiring to import cocaine into the United States and conspiring to launder a significant sum of money, charges which carry sentences ranging from 20 years to life.

After a trial spanning seven days, a diverse jury rendered a guilty verdict against the former politician who also faces potential fines amounting to US$10 million. The jurors deliberated for a mere four hours before arriving at their decision. Fahie, who was previously out on bail, was handcuffed and taken into custody.

His journey from the corridors of power to a courtroom in Miami has been nothing short of extraordinary. Arrested on April 28, 2022 by agents of the Drug Enforcement Administration (DEA) at Miami-Opa Locka Executive Airport, Fahie made international headlines, shocking many supporters in his homeland.

Fahie, whose political career once seemed destined for greater heights, the verdict represents a stunning reversal of fortune.

However, as the trial progressed and evidence was presented, the territory closely followed the prosecution’s case which included extensive incriminating conversations recorded by undercover DEA agents, phone records, and testimony from the prosecution’s key witness, Oleanvine Pickering Maynard, who secured a reduced sentence through a negotiated deal.

Maynard and her son, Kadeem Stephan Maynard, found themselves apprehended in the drug sting. The male counterpart also entered into an agreement with federal authorities, resulting in a five-year sentence.

A former mathematics teacher turned lawmaker, he ascended to prominence as the representative for District One in 1999, a position he held steadfastly for 23 years. Throughout his tenure, he wielded significant influence, serving in various ministerial capacities and ultimately assuming leadership of the Virgin Islands Party (VIP).

Fahie led the VIP to a return to power in the 2019 general election, upending the long-standing dominance of the National Democratic Party. His ascent to power was met with both acclaim and scrutiny, reflecting the complex dynamics of Caribbean politics.

Fahie’s once unassailable reputation began to crumble. In November 2022, facing mounting legal pressure and public scrutiny, he resigned from his position as chairman of the VIP and withdrew from the political arena altogether.

Fahie’s sentencing Is scheduled for April 29.
